1. PURPOSE AND LEGAL STATUS
1.1 This Disclaimer Policy ("Disclaimer") governs the use of the Matric2Tertiary platform ("Platform") and forms an integral part of the Terms and Conditions applicable to all Users.
1.2 This Disclaimer is intended to:
- Define the scope and limitations of the Platform
- Limit legal liability to the extent permitted under South African law
- Clarify the nature of the information and services provided
1.3 By accessing or using the Platform, the User acknowledges that they have read, understood and agreed to this Disclaimer.
2. NATURE OF THE PLATFORM
2.1 The Platform is an educational guidance and decision-support tool designed to assist learners in exploring academic pathways from secondary to tertiary education.
2.2 The Platform provides:
- Admission Point Score (APS) calculations
- Academic pathway mapping
- Faculty-based study guidance
- AI-assisted academic recommendations
2.3 The Platform does not:
- Process or submit university applications
- Make admission decisions
- Represent or act on behalf of any educational institution
2.4 The Platform includes access to independent tutoring services and integrated payment functionality. ROCVEST acts solely as an intermediary and does not provide tutoring services or guarantee any outcomes arising from such services.
3. INFORMATIONAL PURPOSE ONLY
3.1 All information, outputs and recommendations generated by the Platform are provided for general informational purposes only.
3.2 The Platform does not constitute:
- Academic counselling
- Career advice
- Professional or expert advice of any nature
3.3 Users are expressly advised to consult official university prospectuses, accredited academic advisors and relevant institutions before making any academic or career decisions.
4. NO GUARANTEE OF OUTCOMES
4.1 ROCVEST makes no representations or warranties, whether express or implied, that:
- A User will meet admission requirements for any institution
- A User will be accepted into any programme
- Any academic pathway presented will result in a specific outcome
4.2 All outcomes relating to university admissions and academic progression remain solely within the discretion of the relevant institutions.
5. ACCURACY AND COMPLETENESS OF INFORMATION
5.1 While reasonable efforts are made to ensure that information on the Platform is accurate and up to date:
- Information may be incomplete, outdated, or subject to change
- APS calculations are estimates based on generalised models
- Academic requirements may vary between institutions and over time
5.2 ROCVEST does not warrant the accuracy, completeness, or reliability of any information presented.
6. USE OF ARTIFICIAL INTELLIGENCE
6.1 The Platform may utilise artificial intelligence and automated systems to generate outputs and recommendations.
6.2 The User acknowledges and agrees that:
- AI-generated outputs are probabilistic and not deterministic
- Outputs may contain inaccuracies, omissions, or errors
- AI systems rely on underlying data which may be limited or imperfect
6.3 AI-generated content must not be relied upon as definitive, authoritative, or binding.
7. USER RESPONSIBILITY
7.1 The User bears full responsibility for:
- The accuracy of information entered into the Platform
- Any reliance placed on outputs generated by the Platform
- Any decisions made based on such outputs
7.2 The User undertakes to independently verify all information prior to acting upon it.
7.3 Users are solely responsible for evaluating the suitability of any Tutor prior to engaging their services.
8. LIMITATION OF LIABILITY
8.1 To the fullest extent permitted by applicable law, ROCVEST shall not be liable for any loss or damage arising from: Use of or reliance on the Platform; Errors or omissions in information; Inaccurate or incomplete AI-generated outputs; Any academic or career decisions made by the User.
8.2 Without limiting the generality of the above, ROCVEST shall not be liable for: Loss of opportunity; Loss of income or future earnings; Loss of educational prospects; Indirect, consequential, or special damages.
8.3 ROCVEST does not guarantee uninterrupted availability of the Platform, tutoring services, or payment functionality and shall not be liable for any disruption caused by third-party systems.
8.4 Nothing in this Disclaimer excludes liability where such exclusion is prohibited under the Consumer Protection Act 68 of 2008.
9. THIRD-PARTY INFORMATION AND REFERENCES
9.1 The Platform may reference information derived from:
- University prospectuses
- Public academic resources
- External publications
9.2 ROCVEST does not control such third-party information, does not guarantee its accuracy or completeness, and does not endorse any institution or programme.
10. NO PROFESSIONAL RELATIONSHIP
10.1 Use of the Platform does not create a professional advisor-client relationship or any fiduciary duty on the part of ROCVEST.
10.2 ROCVEST does not assume responsibility for providing personalised academic or career advice.
11. SYSTEM LIMITATIONS AND AVAILABILITY
11.1 The Platform is dependent on: Internet connectivity; System availability; External data sources.
11.2 ROCVEST does not guarantee uninterrupted or error-free access.
12. ASSUMPTION OF RISK
12.1 The User acknowledges that use of the Platform is undertaken entirely at their own risk.
12.2 The User assumes full responsibility for: Evaluating the suitability of the Platform; Any consequences arising from its use.
13. MINORS AND PARENTAL RESPONSIBILITY
13.1 Where the User is under the age of 18: Use of the Platform must be under parental or guardian supervision.
13.2 The parent or guardian assumes responsibility for: The minor's use of the Platform; Any reliance placed on Platform outputs.
14. REGULATORY COMPLIANCE
14.1 This Disclaimer is intended to comply with: The Consumer Protection Act 68 of 2008; The Electronic Communications and Transactions Act 25 of 2002; Applicable common law principles.
14.2 Any provision found to be unenforceable shall be severable without affecting the remainder.
15. AMENDMENTS
15.1 ROCVEST reserves the right to amend this Disclaimer at any time.
15.2 Updated versions will be published on the Platform.
16. ACCEPTANCE
By using the Platform, the User confirms that they: Have read and understood this Disclaimer; Accept its terms; Agree to be bound by its provisions.
